2. What do we process your data for (purpose of processing) and on what legal basis?
We process personal data that we have received from you as part of your application and the subsequent application process. In addition, we process - insofar as this is necessary for the application process - personal data that we permissibly obtain from publicly accessible sources (e.g. professional networks on the Internet) or that are transmitted to us by other companies with which we are affiliated under company law or by other third parties (e.g. police clearance certificate from the Federal Central Register). In particular, we may also have received data from service providers (e.g. job placement services). We process personal data in accordance with the provisions of the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).
(a) to fulfill contractual obligations (Art. 6 para. 1 b DSGVO in conjunction with Art. 88 DSGVO and § 26 para. 1 sentence 1 BDSG). The processing of data is carried out for the implementation of pre-contractual measures in response to your application (inquiry).
(b) in the context of balancing interests (Art. 6 para. 1 f DSGVO in conjunction with Art. 88 DSGVO and § 26 para. 1 BDSG) To the extent necessary, we process your data to protect legitimate interests of us or third parties. This applies in particular to calling up profile pages of individual applicants on job-related networks (e.g. Xing and LinkedIn).
(c) based on your consent (Art. 6 para. 1 a DSGVO in conjunction with Art. 88 DSGVO and Section 26 para. 2 BDSG) Insofar as you have given us consent to process personal data for specific purposes (e.g. extended storage of application documents), the lawfulness of this processing is based on your consent. Consent given can be revoked at any time. The revocation of consent only takes effect for the future and does not affect the lawfulness of the data processed until the revocation.
(d) on the basis of statutory or legal requirements (Art. 6 para. 1 c DSGVO as well as Art. 88 DSGVO and § 26 BDSG) or in the public interest (Art. 6 para. 1 e DSGVO) In addition, as a bank we are subject to various legal obligations, in particular under the German Banking Act and the German Money Laundering Act, which oblige us to process personal data.
3. How long will my data be stored?
We store the data that we have obtained from you or collected about you on the basis of your application and during the application process for a period of six months (storage period) after completion of the application process. The application process is completed when you have been hired for the advertised position or when it has been decided that you will not be hired. If you have given us your consent by agreeing to the continued storage of your application documents, we will also store the data beyond the storage period until you revoke your consent.
4. What data protection rights do I have?
You have the right:
- Pursuant to Art. 7 (3) DSGVO, to revoke your consent once given to us at any time. This has the consequence that we may no longer continue the data processing based on this consent for the future;
- to request information about your personal data processed by us in accordance with Art. 15 DSGVO. In particular, you may request information about the processing purposes, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, and the existence of automated decision-making, including profiling, and, if applicable, meaningful information about its details;
- pursuant to Art. 16 DSGVO, to request the correction of incorrect or incomplete personal data stored by us without undue delay;
- in accordance with Art. 17 DSGVO to request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the assertion, exercise or defense of legal claims;
- pursuant to Art. 18 DSGVO, to request the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer require the data, but you need it for the assertion, exercise or defense of legal claims or you have objected to the processing pursuant to Art. 21 DSGVO;
- pursuant to Art. 20 DSGVO, to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request the transfer to another controller; and
- complain to a supervisory authority in accordance with Art. 77 DSGVO. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters for this purpose.
5. Is there an obligation for me to provide data?
As part of the application process, you must provide the personal data that is necessary for the proper selection of applicants and for the fulfillment of legal obligations. Without this data, we will generally not be able to carry out an application procedure.
Information about your right to object according to Article 21 DSGVO.
Under the conditions of Article 21(1) DSGVO, you may object to data processing on grounds relating to the particular situation of the data subject.
You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out on the basis of Article 6(1)(e) DSGVO (data processing in the public interest) and Article 6(1)(f) DSGVO (data processing on the basis of a balance of interests); this also applies to profiling based on this provision within the meaning of Article 4 No. 4 DSGVO.
