Expert (m/f/d) Risk/Legal
Your Tasks:
- Examine and decide on the initiation, continuation and termination of extrajudicial and judicial measures within the scope of competences with regard to legal enforceability, as well as their economic efficiency for the division and TKG as lender/lessor.
- Corresponding and independently negotiating (deciding, offering and closing) with contractual partners or lawyers on debt waivers, settlements/waivers within the framework of existing guidelines for Toyota Kreditbank to minimise defaults and lawsuit risks in the run-up to the proceedings.
- Deciding on and initiating legal proceedings (foreclosure & insolvency) after examining the economic viability and prospects of success with regard to the probability of realisation, as well as subsequently deciding on and initiating coercive measures, such as attachment of salary, property, tax repayment claims, pensions, registration of security mortgages, as well as the arrest of debtors and the initiation of proceedings to obtain a "statement of assets".
- Deciding on and initiating the repatriation of collateral in Switzerland and abroad, after examining its economic viability, in order to realise it and minimise losses.
- Carrying out searches for debtors with the help of external bodies such as residents' registration offices, external service providers and the legally permissible possibilities of the Internet.
- Supervision of insolvency proceedings
- Managing and deciding on the repatriation of vehicles, their continued use by the insolvency debtor and the compensation for their use within the framework of the legal regulations. Managing and deciding on the restructuring support of companies and private individuals through contract rescheduling, redemptions and refinancing, continuations and their monitoring to minimise default
- Assessing and deciding on substitute collateral, the waiver of collateral and creditworthiness checks on debtors for the continuation of unsecured loans. Assessing and deciding on the realisation of collateral vs. refinancing in the event of insolvency with regard to the reduced collateral
- Settlement of deaths in the context of loans/leasing agreements, including clarification of inheritance relationships
Your Profile:
- Successfully completed apprenticeship as a paralegal and/or notary's assistant
- Several years of practical work experience in the banking or insurance industry, or in a law firm
- Knowledge of civil, insolvency and insurance law, as well as knowledge of extrajudicial and judicial dunning procedures
- Problem-solving skills
- Analytical thinking skills
- Proven expertise in the leasing and credit business
- Willingness to make decisions coupled with negotiating skills
- Fluency in both written and spoken German and English language
